"It's one of those cases where you say, 'He did what?!'" said Preble County (Ohio) Prosecutor Martin P. Votel.
He was speaking of Coty J. Heltsley, 20, who had been convicted of hanging out in a portable toilet at a county fair to peek at women using the facility. He "admitted breaking the vents and spying on at least two women for the purpose of sexual gratification," the court record says. Police had been staking out the toilets on suspicion that someone was using them for peeping, and saw him moving two units together. Officers jumped in and arrested Heltsley when they saw him go into a toilet to apparently peek at a 12-year-old girl.
And then it gets weird.
After pleading no contest to the voyeurism charges (the victim "could clearly see the perpetrator's face, eyes, round cheeks, and hair color, and that he was tall in stature. When asked whether appellant was the perpetrator, the victim recognized him immediately, without hesitation," the court record notes), Heltsley appealed his conviction on the theory that police violated his right to privacy by doing surveillance on the toilets from a camper parked nearby.
"I think that's ironic and ridiculous," Votel said. "This particular case, where someone was using a port-a-potty for that type of activity...I was disturbed and disgusted."
Heltsley, who committed the act in July 2008, lost his appeal in December 2009.

For us, he lost his appeal long before that.

I doubt the rotten apple fell too far from the tree. They better check on his family.
