Sometimes a soda is not just a soda.

An Albuquerque, N.M., man is facing charges after he allegedly beat his girlfriend over, of all things, a soda.

Shawn Centeno, 41, allegedly threw the soda at his girlfriend after they had been yelling about the soft drink on Tuesday. She jumped in the shower to wash off the sticky syrup, calling her sister to come pick her up.

After she'd showered, Centeno allegedly continued to argue with her, then hit her in the face with a remote control. When she tried to leave the room, he allegedly pushed her, then beat her several times in the leg with a wrench to try to keep her from running away. Fortunately, she was still able to escape, running to her sister's car.

Centeno fled from the police, first by bike, then by foot. When he wouldn't stop running, police Tasered him. During his arrest, three bags of marijuana allegedly fell out of his pocket, which led the police to retrace their steps, where they found an additional two bags of marijuana.

Centeno is charged with aggravated battery, false imprisonment, possession of marijuana with intent to distribute, and tampering with evidence. This case is his eighth charge of domestic violence since 1996.

Guys like Centeno are what prisons were intended for. Sad we can't keep them out of society permanently because of their behavior.

Domestic violence is usually only a misdemeanor, and the 3-strikes law normally applies only to felonies. Even felonious cases of DV are often plea-bargained down to misdemeanors, just to ensure a conviction since the felonious aspect is much harder to convince a jury. Due mostly to an uncooperative or obstructive victim.

While previous convictions cannot be used against a defendant during trial, a judge CAN consider previous record in sentencing. Still, the maximum sentence for a misdemeanor is only one year.
