Forensics should be able to sort this out. A choke hold should leave some bruising on her neck and collarbone.
Also, if it happened the way he says it, there should be multiple witnesses, with fairly consistent stories.

A choke hold would have her facing AWAY from him. She MIGHT be able to bite his arm, but the only way she could reach his ear would be if he was choking her while she was facing him. I will go with the police report on this.

Hard to say what the hold looked like. Even if he was behind her, he could have made the mistake of putting his head forward, above her shoulder. Still, what I really want to know is what the several witnesses said! -rc

Just guessing, but a party breaking up at 3am might just involve consumption of alcohol. I wouldn't bet on getting consistent statements from witnesses. I'd bet sober people weren't seeing squirrels at 3am either.

When Marc Antony asked the to lend him their ears, I think his intent was to return them.
Good thing I won't be on that jury. Ears don't just tear off from a bite unless the teeth are literally razor sharp. Even a sharp knife would more likely leave lacerations and some tearing.
Carnivorous squirrels, eh? Is that like (former President) Jimmy Carter's killer rabbit that attacked his boat?
