In a major departure from our regular procedure, we're going to show you the mug shot first, and then tell you the story. After you see the shot, try to see if you can decide what Dustin Winesberry, 22, was arrested for in Boulder, Colo., Sunday night.

He's a fine hunk of a man -- and he knows it!

Which may have something to do with his criminal background: Winesberry told officers he is a registered sex offender. He was arrested after allegedly climbing onto an apartment balcony in Boulder and telling the women inside he wanted to "hang out" with them.

One of the quick-thinking women, dressed only in pajamas, ran to the balcony door and locked it before calling police. Winesberry was found by officers nearby. He told officers he was looking for a party that friends were having. He was arrested and charged with attempted second-degree trespass, and held on $1,000 bond.

But once Winesberry's mug shot hit newspapers, something else hit the fan. The jail deputy who took the photo was given a verbal reprimand over the shot.

Posed mug shots "would be useless" in photo line-ups for victims, said Division Chief Larry Hank, the head jailer. Mug shots must all be in essentially the same pose, he said. Winesberry "was being a clown" when the deputy took the mug shot, and the deputy should have put a "hold" on Winesberry until he cooperated. The "hold" would keep him in jail until he allowed a serious mug shot.

"People are uncooperative when they come in," Hank said. "But if the only thing keeping them from being released is a photo, then they tend to be more cooperative."

But the deputy didn't put a hold on Winesberry. "The officer was busy that night," Hank said. "He saw the photo and didn't intend to leave it in the system. But he basically got busy and forgot."

A new photo was taken once Hank was made aware of the situation. "The officer has been talked to and realizes his mistake," Hank said. The new photo:

But Winesberry still hasn't managed to post bail.

If the cutesy photo was used in a police investigation, a defense attorney said, Wineberry's pose might call attention to him. "It would make his photo stand out and could have significant consequences for him," said attorney Scott Robinson. "I have never seen a mug shot that has looked anything other than like a mug shot."

Winesberry was arrested last year after a burglary at the University of Colorado campus. He is on probation after pleading guilty to first-degree criminal trespass, and is serving two years probation. He has no record of any sex crimes in Colorado, and is not a registered sex offender in the state. Which makes us wonder about his record in other states....

I think he had a better shot at raising bail with the first Mug Shot.

Maybe, with the first shot, Dustin was thinking about attracting those women who "date" and marry convicts...
